By accessing or using the services provided by PT Inti Kesles Nusantara ("KESLES", "we", "us", or "our"), including our website, mobile applications, payment infrastructure, and related products (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our Services.
KESLES provides an integrated cashless payment infrastructure connecting transportation, parking, EV charging, and micro, small, and medium enterprises (MSMEs) in Indonesia. Our services include but are not limited to the KTIP transportation payment system, ParQEZ smart parking solutions, EVCE electric vehicle charging services, KSELF self-service kiosks, and Merchant payment solutions for MSMEs.
To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. KESLES reserves the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these terms.
All transactions processed through the KESLES platform are subject to the applicable fees and charges as displayed at the time of the transaction. Payments are processed through our authorized payment partners and are subject to their respective terms of service. You agree that all transaction records maintained by KESLES shall be considered accurate unless proven otherwise. Refunds and disputes will be handled in accordance with our refund policy and applicable Indonesian regulations.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not use the Services to engage in any fraudulent, deceptive, or illegal activity; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the integrity or performance of the Services; transmit any viruses, malware, or harmful code; reverse engineer, decompile, or otherwise attempt to extract the source code of our software; or use the Services in any manner that could damage, disable, or impair KESLES's infrastructure.
All content, trademarks, logos, software, and intellectual property associated with KESLES and our Services are the exclusive property of PT Inti Kesles Nusantara or its licensors. You may not reproduce, distribute, modify, or create derivative works based on any part of our Services without prior written consent from KESLES.
To the maximum extent permitted by applicable law, KESLES shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, our Services. This includes but is not limited to loss of profits, data, or goodwill. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to KESLES in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless KESLES, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from or related to these Terms shall be resolved through the competent courts in Jakarta, Indonesia, unless otherwise required by applicable consumer protection laws.
KESLES reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting the updated terms on our website. Your continued use of the Services after any modifications constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
KESLES may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law.
